1. Binding Agreement & Deposits
- Irrevocability: This Agreement is legally binding and governed by South African law. By paying a deposit or taking possession of equipment, the Client waives the right to claim they did not read or agree to these terms.
- Non-Refundable Deposit: A 50% non-refundable hire fee is required to secure a date. This deposit acts as liquidated damages should the Client cancel.
- Minimum Order: Minimum rental of R1,000 (excl. delivery) applies on chaffers/warmers; basic combo minimum R1,500.
2. Damage, Theft & the "No Ownership" Rule
- No Ownership Transfer: Payment for damaged/lost items is compensation only. Ownership does NOT transfer to the Client. The Company retains all damaged items even after full payment.
- Replacement Value: Liability is the current new replacement cost plus shipping and assembly — not depreciated value.
- Third-Party Damage: The Client is 100% liable for damage caused by venue staff, guests, or third-party coordinators. Payment to the Company is immediate — not deferred pending recovery from third parties.
3. Refundable Breakage Deposit
- The Company may apply the breakage deposit to any outstanding obligation including late fees, cleaning fines, or unpaid transport surcharges.
- Refund Timeline: Processed within 10–21 working days after full return. The 21-day clock starts only once the final missing item is recovered.
4. Collection, Returns & Search & Recovery
- All goods must be gathered in one central, accessible location. A Search & Recovery fee (min. R1,000) applies if staff must search the venue.
- Count Finality: Unless the Client witnesses the return count and signs the return slip, the Company's count is final and binding.
- Late Penalties: R500 penalty plus a full daily hire rate for every 24-hour period (or part thereof) until returned.
5. Specific Product Care
- Use only products supplied with the machines. Follow all instructions provided.
- Equipment may never be left outdoors overnight or on wet surfaces. Moisture damage results in a full replacement charge.
- All chaffer pots must be wrapped in original packaging on return.
6. Cancellation & Postponement
30+ days prior: 25% of total quote
15–29 days prior: 50% of total quote
14 days or less: 100% of total quote
- Postponement credit (same items, within 6 months) may be granted at the Company's discretion. Admin fee applies — not more than R350.
7. Indemnity & Limitation of Liability
- The Client fully indemnifies the Company against all claims including injury, death, or loss, even arising from equipment malfunction.
- The Company is not liable for lost profits or event failure due to delays caused by traffic, weather, or courier issues.
8. Legal Costs & Jurisdiction
- In any dispute, the Client pays all legal costs on an Attorney-and-Client scale, including collection commission and tracing fees.
